Terms and Conditions

1. Agreeing to these terms

These Terms and Conditions ("Terms") are an agreement between you and Vaishnex, owned and operated by Ajay Pagare (Founder, CEO and Owner), Mumbai, Maharashtra, India ("Vaishnex", "we", "us"). By creating an account or using vaishnex.com or the Vaishnex app, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Vaishnex.

2. Who can use Vaishnex

• You must be 18 or older, or have the verifiable consent of a parent or guardian who agrees to these Terms for you.
• You must be able to enter a binding contract under Indian law, and not be barred from using Vaishnex by any law.
• If you use Vaishnex for a business, you confirm you are allowed to accept these Terms for that business.

3. Your account

• Give a real email address that you control. We use it to send codes and important notices.
• Keep your password secret. You are responsible for what happens on your account.
• Tell us at team@vaishnex.com if you think someone else has used your account.
• Do not pretend to be another person, brand or business, and do not sell or transfer your account.

4. Your content

You own your content. The videos, photos, captions and other material you post stay yours.

To run Vaishnex, you give us a non-exclusive, royalty-free, worldwide licence to host, store, copy, resize, format and show your content to the people you chose in that post's settings. This licence covers only running and improving Vaishnex. It ends when you delete the content or your account, except for copies others have already remixed with your permission, and backups we delete within our normal cycle.

You confirm that you made the content or have every permission needed to post it, including from people who appear in it and from owners of any music, footage, images or brands in it. Do not upload other people's content without their permission.

5. Remix and downloads

• Each post has its own setting for downloads and remix. Both are off unless you turn them on.
• If you allow remix, other users may reuse that post inside Vaishnex, and every remix credits you.
• If you remix someone's post, you must keep the credit and follow any limits they set.
• Downloading a post someone allowed does not give you the right to sell it or claim it as yours.

6. Community rules

You must not use Vaishnex to post, share or do anything that:

• is illegal in India, or helps someone break the law;
• harms, exploits or sexualises children in any way;
• is sexually explicit, or shares intimate images of someone without their consent;
• threatens, harasses, bullies or promotes violence or hatred against any person or group;
• is false or misleading in a way that could cause harm, including fake products, fake reviews or scams;
• copies someone else's work, brand or identity without permission;
• shares another person's private information without their consent;
• sends spam, malware, or tries to hack, overload, scrape or get around the security of Vaishnex;
• sells items that are banned or restricted by law.

7. Shops and orders

• Shops are run by their owners, not by Vaishnex. The shop is responsible for its products, prices, descriptions, delivery, returns, refunds and taxes.
• When you order, the contract for the item is between you and the shop. Vaishnex provides the tools that connect you.
• Shops must describe items honestly and must not use packing proof videos to mislead buyers.
• If something goes wrong with an order, contact the shop first. You can also report the shop to us, and we may act on its account.
• Vaishnex does not collect card or bank details. Any payment arrangement is between the buyer and the shop.

8. Vaishnex AI

Vaishnex AI can help with ideas, captions, scripts and subtitles. AI answers can be wrong or incomplete, so check them before you rely on them or post them. You are responsible for what you post, including AI-assisted content. Do not use Vaishnex AI to create content that breaks section 6. Each account has a daily AI limit.

9. Vaishnex's rights

The Vaishnex name, logo, design, software and features belong to Vaishnex and are protected by law. These Terms do not give you any right to use them except to use the service as intended. If you send us ideas or feedback, we may use them without owing you anything.

10. Reporting and removal

If you see content that breaks these Terms or infringes your rights, report it to team@vaishnex.com with the link and the reason. We follow the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We acknowledge complaints within 24 hours and aim to resolve them within 15 days, and we act faster where the law requires it. We may remove content or limit an account while we look into a report.

11. Suspension and closing

• You can stop using Vaishnex and ask us to delete your account at any time.
• We may remove content, or suspend or close an account, if it breaks these Terms or the law, or puts users or Vaishnex at risk. Where it is safe and lawful, we will tell you why and let you respond.
• Sections that by their nature should continue (such as 9, 12, 13 and 14) still apply after your account ends.

12. No guarantees

We work hard to keep Vaishnex running well, but it is provided "as is" and "as available". We do not promise that it will always be available, error-free or that content on it is accurate. Keep your own copies of anything important; drafts saved in your browser can be lost if browser data is cleared.

13. Limit of liability

To the extent the law allows, Vaishnex and its owner are not liable for indirect or consequential losses, such as lost profits, lost data or lost business, or for content posted or products sold by other users. Our total liability to you for any claim about Vaishnex is limited to the amount you paid us in the 12 months before the claim, or ₹1,000 if you paid nothing. Nothing in these Terms limits liability that cannot be limited under Indian law.

14. Law and disputes

These Terms are governed by the laws of India. If a dispute arises, please write to us first so we can try to resolve it. If it is not resolved, the courts in Mumbai, Maharashtra will have exclusive jurisdiction.

15. Changes to these terms

We may update these Terms as Vaishnex grows. We will change the date above, and for important changes we will tell you in the app or by email before they take effect. If you keep using Vaishnex after that, you accept the new Terms.
